Snapchat, a widely popular social media platform known for its disappearing messages feature, is under fire for allegedly facilitating criminal activities targeting minors. New Mexico Attorney General Raúl Torrez has filed a lawsuit against Snap, the owner of Snapchat, accusing them of violating state laws and creating a dangerous environment for children.
One of the primary arguments made by Torrez is that Snapchat’s design elements, such as disappearing messages, lull users into a false sense of security. The app’s claim of being “more private” and “less permanent” than other social media platforms is deemed misleading, as predators can easily capture and store sensitive content shared by unsuspecting individuals.
Torrez’s office conducted an undercover investigation, creating a fake Snapchat account posing as a 14-year-old girl named Heather. The decoy account interacted with profiles with disturbing usernames like “child.rape” and “pedo_lover10,” resulting in attempts to solicit child sexual abuse material (CSAM). This alarming discovery sheds light on the dark reality of predatory behavior on the platform.
Further exacerbating the situation, Torrez’s office uncovered over 10,000 records related to Snap and CSAM on the dark web in 2023. Snapchat was identified as the largest source of illicit images and videos among the sites investigated, highlighting the pervasive nature of the issue. The platform’s supposed security features prove inadequate in thwarting criminal activities.
Torrez’s approach to holding tech companies accountable for their product design and functionality mirrors his successful litigation against Meta in the past. By targeting Snapchat’s features that enable predatory behavior, Torrez aims to address the root cause of the problem. The lawsuit seeks to halt Snap’s alleged illegal practices, impose penalties, and require the company to forfeit any ill-gotten gains.
The legal battle between Torrez and Snap raises important questions about the responsibilities of tech companies in safeguarding their users, particularly minors, from harm. While Section 230, a legal shield protecting platforms from user-generated content, may not shield Snapchat from liability in this case, the court’s decision could set a precedent for future lawsuits against similar platforms.
